Applicant was a 51 year old bus driver with a history of neck and back fusion and elbow injuries, whom was involved in a minor accident the morning of his termination for cause. After being fired, Applicant filed a claim alleging that as a result of the accident, he suffered injury and/or aggravation of his prior injuries to his back, neck, upper extremities, neck and shoulders.
Mr. Sutow conducted his investigation, interviewed witnesses, gathered reporting and obtained a PQME in Orthopedics, whom initially found compensable injury to all body parts alleged. After two cross-examinations of the PQME and a Trial, Mr. Sutow obtained a take-nothing finding, saving our client nearly $100k in anticipated disability and future medical care.
